(Art. 8 VITH - Ordinance on integrity and transparency in the field of therapeutic products)

In 2016, the Swiss Parliament said YES to very strong regulatory measures in the Therapeutic Products Act, also in order to finally implement the KVG Article 56 on the passing on of discounts in a patient-centred manner. The Ordinance on Integrity and Transparency in the Therapeutic Products Sector (VITH) entered into force on 1.1.2020.

However, a strong regulation also brings its positive aspects. The text of the regulation states that it is still possible to negotiate discounts. It is required to pass at least 51% of these price reductions on to patients. After all, 49% remain,
meaning that out of a negotiated discount of 15%, almost 7.5% will remain to the practice or clinic. The health insurance companies originally expected that discount repayment contracts were negotiated directly with them. Probably they are stuck on their hope.

However, the Swiss Academy of Ophthalmology can guarantee that the money is used in a way that is beneficial to patients, as we use it for research, training and other targeted projects, which we can then demonstrate to the FOPH (Federal Office of Public Health). The SAoO has therefore set up a fiduciary VITH account into which the share of the discount to be transferred to the patients can be paid without the foundation having to be informed of the origin of the funds. The payer receives a confirmation, valid for tax purposes, since these are real donations.

With this measure, we believe we have created a win-win situation.
